Welcome to the Tenable Network Security, Inc. ("Tenable") group of web sites (the "Site"). Please review the following terms of service concerning your use of the Site (the "Terms"). BY USING THE SITE, YOU AGREE TO THESE TERMS AND THE PRIVACY POLICY; IF YOU DO NOT AGREE, DO NOT USE THE SITE. As long as you comply with these Terms, Tenable grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Site.

RESTRICTIONS ON USE OF SITE
You may not collect any product listings, descriptions, or prices for your commercial use. You may not download or copy account information for the benefit of another merchant. You may not engage in "deep-linking" or make use of data mining, robots, or similar data gathering and extraction tools on the Site. You may not reproduce or copy the Site or any portion of the Site for any commercial purpose without express written consent of Tenable. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Tenable without express written consent. You will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Site or Tenable's systems or networks, or any systems or networks connected to the Site. You may not probe, scan or test the vulnerability of the Site or any network connected to the Site, nor breach security or authentication measures used on the Site or any network connected to the Site.

USE OF MATERIALS
All materials provided on the Site, including but not limited to information, documents, logos, text, graphics, sounds, images, software and all other content of any description available on the Site or included in any products or services we offer (collectively, "Materials"), are provided either by Tenable or by their respective third party manufacturers, authors, developers and vendors ("Third Party Providers") and are the copyrighted work of Tenable and/or the Third Party Providers. Except as stated herein, none of the Materials may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means, including but not limited to electronic, mechanical, photocopying, recording or other means, without the prior express written permission of Tenable or the Third Party Providers, as applicable. Materials provided by Third Party Providers have not been independently reviewed, tested, certified, or authenticated in whole or in part by Tenable. Tenable does not provide, sell, license, or lease any of the Materials other than those specifically identified as being provided by Tenable.

Tenable hereby grants you permission to display, copy, distribute and download Tenable's Materials on the Site provided that: (1) both the copyright notice identified below and this permission notice appear in the Materials; (2) the use of such Materials is solely for personal, non-commercial and informational use, and such Materials will not be copied or posted on any networked computer, broadcast in any media, or used for commercial gain; and (3) the Materials are not modified in any way.

Tenable's Materials include white papers, videos, and information providing descriptions of specific vulnerabilities (the "Specified Materials") owned by Tenable and posted on the Site. Tenable grants you permission to post the unmodified Specified Materials on your site, provided that: (1) the appropriate copyright notice is included with each of the Specified Materials; (2) the use of the Specified Materials is for non-commercial and informational use only; (3) you properly attribute the Specified Materials to Tenable and provide a link back to the Site; (4) nothing on your site reflects negatively on Tenable or its products; and (5) you agree that Tenable may withdraw this permission at any time for any reason.

If you have any questions about the scope of your ability to use the Specified Materials or any other of Tenable's Materials, please contact Tenable as described in the "Legal Contact Information" section below. Any permission described in these Terms terminates automatically without notice if you breach any of these Terms. Upon termination, you will immediately destroy any downloaded or printed Materials.

Except where expressly provided otherwise by Tenable, nothing on the Site shall be construed to confer any license under any of Tenable's or any Third Party Provider's intellectual property rights, whether by estoppel, implication, or otherwise. You acknowledge sole responsibility for obtaining any such licenses. Any unauthorized use of any Materials contained on the Site may violate intellectual property laws, the laws of privacy and publicity, communications regulations and statutes, or other applicable laws.

YOUR ACCOUNT
If you use the Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. Tenable reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.

LINKS TO THIRD PARTY SITES
The Site may contain links to web sites controlled by parties other than Tenable. Tenable is not responsible for and does not endorse or accept any responsibility for the contents or use of these third party web sites. Tenable is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Tenable of the linked web site. It is your responsibility to take precautions to ensure that whatever materials you copy or download from third party web sites are free of viruses or other items of a destructive nature.

ELECTRONIC COMMUNICATIONS
When you visit the Site or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. RESTRICTED RIGHTS LEGEND
Any software that is downloaded from the Site for or on behalf of the United States of America, its agencies and/or instrumentalities ("U.S. Government") is provided with Restricted Rights. Tenable shall be free to use and/or disseminate such Submissions on an unrestricted basis for any purpose. You acknowledge that you, not Tenable, have full responsibility for the Submissions that you provide, including their legality, reliability, appropriateness, originality and copyright.

LOCAL LAWS; EXPORT CONTROL
Tenable controls and operates the Site from its headquarters in the United States of America and makes no representation that the Materials are appropriate or available for use in other locations. If you use the Site from other locations, you are responsible for compliance with applicable local laws, including but not limited to the export and import regulations of other countries. Unless otherwise explicitly stated, all marketing or promotional materials found on the Site are solely directed to individuals, companies or other entities located in the United States of America. You acknowledge and agree that the Materials are subject to the U.S. Export Administration laws and regulations. Diversion of the Materials in breach of such laws and regulations, or any other federal, state, local or foreign law, is prohibited. Tenable and the Third Party Providers may make improvements and/or changes in the products, services, programs, and prices described on the Site at any time without notice. Tenable may periodically make changes to the Site. Any action related to these Terms will be governed by Maryland law and controlling U.S. federal law. No choice of law rules of any jurisdiction will apply. You agree that any proceeding to enforce these Terms will be brought in a state or federal court located in Maryland. You agree to submit to the personal jurisdiction of these courts for the purpose of any proceeding to enforce these Terms and waive any objections to venue in these courts. These Terms represent the entire understanding relating to the use of the Site and prevail over any prior or contemporaneous, conflicting or additional, communications. Tenable has the right to revise these Terms at any time without notice by updating this posting. Any subsequent use of the Site by you will be governed by the revised Terms. Any rights not expressly granted herein are reserved by Tenable. Headings are used in these Terms for reference purposes only and shall not be used to interpret or construe these Terms. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be stricken and the remaining provisions enforced.

INTELLECTUAL PROPERTY NOTICES
Elements of the Site are protected by trade dress and other laws and may not be copied or imitated in whole or in part. No logo, graphic, sound or image from the Site may be copied or retransmitted unless expressly permitted by Tenable.

Privacy Notice


The Tenable Network Security group of web sites (the "Site") is owned and operated by Tenable Network Security, Inc. ("Tenable"). Tenable collects personally identifiable information and non-personal information on the Site. Tenable is committed to protecting your privacy. We have created this Privacy Policy to explain how we collect and use personally identifiable information. WHAT INFORMATION IS COLLECTED?
We collect personally identifiable information about you if you choose to purchase, register or apply online for one of our products, services, promotions or other online activities. Our online activities include web seminars, support responses, user surveys, product demonstrations, registration for our partner program and access to downloadable software and documents. When you register or apply for one of our online activities, you complete a form that may require you to provide personally identifiable information, including your full name, email address and telephone number. To the extent you utilize our online store, you may also provide your credit card information and mailing address.

HOW DOES TENABLE USE MY INFORMATION?
We use your personally identifiable information to deliver the services you have requested, to evaluate your registration or application for our products and services, to process your request for information and to contact you if we need more information. We may use personally identifiable information to contact a user in connection with the user's inappropriate use of the Site. We may also use your email address, telephone number or mailing address:

  • for internal marketing purposes to obtain feedback on our products, the Site or on other aspects of our business;
  • to notify you of new products or services that we think may be of interest to you;
  • to send you promotional materials; and
  • to provide you with a newsletter.

We use anonymous information, such as aggregate data about visitors to the Site, to determine how to improve the Site, marketing and services, how visitors find out about the Site and which of our online services most interest visitors to the Site. We also may share anonymous information with third parties. This anonymous information cannot be used to identify you personally.

DOES TENABLE COLLECT INFORMATION ABOUT CHILDREN?
We respect the sensitive nature of children's privacy online. You must be at least 18 years old to register, purchase or apply online for our products, services, promotions and other activities. If you are under the age of 18, please do not provide us with any information about yourself.

WHAT TYPE OF SAFEGUARDS DOES TENABLE USE?
The security and confidentiality of your information is extremely important to us. We have implemented technical, administrative, and physical security measures to protect your personal information from unauthorized access and improper use. From time to time, we review our security procedures in order to consider appropriate new technology and methods. Please be aware though that, despite our best efforts, no security measures are perfect or impenetrable.

DOES TENABLE'S PRIVACY POLICY APPLY TO LINKED WEB SITES?
Our Privacy Policy applies solely to information collection practices on the Site. The Site contains links to other sites. Please be aware that Tenable has no control or influence over the privacy practices of other web sites and that our Privacy Policy does not apply when you leave the Site. We encourage you to read the privacy policies of each web site you visit.

YOUR CALIFORNIA PRIVACY RIGHTS
A California resident who has provided us with personal information (a "California Customer") is entitled to request information about whether we have disclosed personal information to any third parties for the third parties' direct marketing purposes. If so, upon receipt of a request by a California Customer, we will provide a list of all third parties to whom personal information was disclosed in the preceding calendar year, as well as a list of the categories of personal information that were disclosed.

Except as otherwise stated in this Privacy Policy (including, but not limited to, sharing information with our third party resellers), we do not share information with third parties for their direct marketing purposes unless you affirmatively agree to such disclosure. To prevent further disclosure of your personal information for use in direct marketing by a third party, do not opt in to such use when you provide personally identifiable information on the Site. If you opt in to receive communications from a third party, your information will be subject to the third party's privacy policy. If you later decide that you do not want that third party to use your information, you will need to contact the third party directly, as we have no control over how third parties use information. Please note that we are only required to respond to one request per customer each year, and we are not required to respond to requests made by means other than through this e-mail address.

You may correct or update the personally identifiable information collected about you on the Site. To correct or update your personally identifiable information, please contact marketing@tenable.com.

CHANGES TO THIS PRIVACY POLICY
We may change this Privacy Policy at any time without notice. If we change this Privacy Policy, we will post the changed Privacy Policy on the Site so that you are always aware of what type of information we collect, how we use it and under what circumstances, if any, we disclose it to third parties.
